Empanelment Standards

Thank you for your interest in becoming an empaneled member of the BICAM Panel!

BICAM maintains high standards for empanelment to ensure that the integrity and quality of arbitration and mediation proceedings are kept to the finest standards. We are proud to have renown and esteemed arbitrators and mediators of diverse backgrounds and expertise from all over the world in our panel. The arbitrators and mediators listed on the BICAM Panel are available for mutual nomination between parties in BICAM administered proceedings, or where parties are unable to agree on a nominee, the panel list is used by BICAM to appoint a suitable neutral.

Admission to BICAM's Panel

  1. Admission to BICAM's Panel is upon an application being made to BICAM, or upon invitation by BICAM. Applications are to be made online through the BICAM website.
  2. Applicants who wish to apply for admission to BICAM's Panel will be required to meet the minimum standards of empanelment. Notwithstanding anything provided therein, BICAM may, subject to its own discretion, exempt any person from any such criteria and/or eligibility for the purpose of admitting such person to the BICAM Panel.
  3. Admission to the BICAM Panel is for a three year-term from the date of the applicant's successful empanelment and issuance of the empanelment certificate in respect thereof.
  4. Should any clarifications be required, BICAM will notify the applicant within four (4) weeks from the date of submission of the online empanelment application.
  5. BICAM will inform all applicants of the outcome of their application, in writing, via email.
  6. BICAM's decision to approve or reject an application for empanelment to the BICAM Panel shall be final.
  7. BICAM reserves the right, in its absolute discretion, to remove any person from the BICAM Panel at any time.
  8. BICAM's decision to reject an application for empanelment, or remove a panelist from the BICAM Panel, shall be in writing with reasons provided.
  9. It is the responsibility of all successful panelists to ensure that the personal details and information displayed on the BICAM Panel and any CV uploaded, are accurate and updated. BICAM bears no responsibility for any inaccurate information displayed and any resulting loss of opportunity arising therefrom.

BICAM's Minimum Standards for Empanelment of Arbitrators

An applicant seeking empanelment as a BICAM Arbitrator must satisfy the following minimum standards of empanelment as arbitrator:

  • Tertiary Education;
  • Fit and of sound mind to serve and act as Arbitrator;
  • Minimum 15 years of active post-qualification experience;
  • Minimum 10 years of active experience in arbitration proceedings, whether as Counsel, or experience as an Arbitrator including having completed at least two arbitral awards, or served in any other capacity in an arbitration proceedings or practice;
  • Fellowship from the Chartered Institute of Arbitrators (CIArb) or any other comparable professional institute or organisation, including pre-qualifications, memberships and acceptances to such institutes or organisations;
  • Is not a bankrupt nor convicted of any criminal offence within or outside Malaysia; and
  • Not subject to any sanction by any country.

*An applicant who served as a Judge of Superior Court may also apply to BICAM to be empanelled as Arbitrator with the following minimum standards of empanelment as arbitrator:

  • Tertiary Education;
  • Fit and of sound mind to serve and act as Arbitrator;
  • Minimum 15 years of active post-qualification experience;
  • Is not a bankrupt nor convicted of any criminal offence within or outside Malaysia; and
  • Not subject to any sanction by any country.

BICAM's Minimum Standards for Empanelment of Mediators

An applicant seeking empanelment as a BICAM Mediator must satisfy the following minimum standards of empanelment as mediator:

It is crucial to note that the provision of written feedback is a fundamental aspect of the empanelment committee's decision-making process. Failure to provide such feedback may have a substantial impact on the empanelment decision. This feedback can take the form of an email from counsel or parties, serving as confirmation that mediation has indeed been conducted.

  • Tertiary Education;
  • Fit and of sound mind to serve and act as Mediator;
  • Minimum 10 years of active post-qualification experience;
  • Accreditation as mediator from a recognised professional organisation or a professional body;
  • Conducted and/or has been involved in at least two mediation proceedings as a Mediator and is able to furnish at written feedback of mediations conducted;
  • It is crucial to note that the provision of written feedback is a fundamental aspect of the empanelment committee's decision-making process. Failure to provide such feedback may have a substantial impact on the empanelment decision. This feedback can take the form of an email from counsel or parties, serving as confirmation that mediation has indeed been conducted.
  • Is not a bankrupt nor convicted of any criminal offence within or outside Malaysia; and
  • Not subject to any sanction by any country.
